Swish XR LLC Game – Terms & Conditions for All Players and Participants

1. Prizes (Competition Play Only)

1st Place (Highest Score): A real signed basketball by Dominique Wilkins.

2nd Place: $100 gift card.

3rd Place: $50 gift card.

Prizes are non-transferable and may not be substituted for cash. Winners are subject to verification

2. Play Types

2.1 Swish Free Play

- Free of charge.

- Registration and ticket required.

- Participants must accept these Terms & Conditions before playing.

- This mode is for entertainment only; no prizes are awarded.

2.2 Swish Competition Play

- Paid ticket required for entry.

- Participants compete in the Superstar Game to earn as many points as possible.

- Each paid ticket provides one (1) official gameplay session.

- Participants may purchase additional tickets to attempt multiple gameplays.

- Only this mode qualifies for prizes as described in Section 1.

3. Eligibility

Open to all registered Evermore event participants. Each participant must be at least 10 years of age. Minors must have a parent or guardian register on their behalf and accept these Terms & Conditions. Any participant not following resort or gameplay rules or that is impaired by alcohol or other substances can be denied entry.

4. Gameplay Rules

- Each ticket purchased equals one (1) official gameplay session.

- A 'swish' is defined solely by the XRHooper system.

- Players may shoot from any distance; longer shots may be worth more points.

- An official judge must witness gameplay for eligibility.

-Closed-toe shoes are required; failure to comply may result in disqualification.

Game Play Conduct

1. No dunking.

2. No pushing, roughhousing, or physical interference.

3. One play per turn.

5. Disqualification Conditions

A participant will be disqualified if any of the following occur:

- Using more than one ball at a time.

- Shooting from incorrect distances or violating scoring rules.

- Playing without an official judge present.

- Dunking on the hoop, climbing, or standing on any person or object.

- Violating any gameplay rules listed above.

6. Media Release

By participating, participants grant Swish XR LLC and Evermore the right to record, photograph, and otherwise capture their participation. All media may be used for promotional, advertising, and publicity purposes in any format without compensation. Participants waive any right to inspect or approve the finished materials.

7. Liability Release & Assumption of Risk

Participation in the Game involves physical activity and carries inherent risks, including risk of injury. By registering and playing, participants voluntarily assume all risks related to participation.

Participants, on behalf of themselves and their heirs, release and hold harmless Swish XR LLC, Evermore, event staff, sponsors, and affiliates from any and all liability, claims, or damages arising out of participation, including personal injury or property damage. Participants agree to abide by all rules and instructions from officials. Failure to comply may result in removal without refund.

8. Property Damage

Participants are expected to use all equipment and facilities responsibly. Any participant who causes damage to property, equipment, or facilities—whether intentional or due to reckless behavior—may be held financially liable for the costs of repair or replacement as determined by Swish XR LLC and the Evermore event organizers.

9. Agreement

By registering and receiving a ticket, participants acknowledge they have read, understood, and agreed to these Terms & Conditions. Agreement is automatic upon ticket purchase or free play registration; no signature is required.
